PLETTENBERG BAY – The lawyer representing Bitou Municipal Manager Mbulelo Memani has demanded that the municipality give instructions to the Knysna Sheriff to immediately release Memani's movable property, including a BMW X3, seized on 17 July.
Lawyer Bulelani Bans sent a letter to Bitou Mayor Jessica Kamkam on 8 August that included proof of payment for R302 581 – the final outstanding amount of R1 691 510.86 the Bitou Municipality said Memani owed for a mutual severance agreement paid to him last year.
The bank's proof of payment indicated Memani repaid R302 581 - 66c more than the R302 580.34 outstanding.
Due
Kamkam, in a letter to Bans dated 5 Au-gust, said after accounting for payments already received there was an outstanding balance of R302 580.34 that remained due to the municipality.
She said until the full amount was settled, the assets attached would "remain under judicial attachment" and the municipality reserved the right to proceed with further legal action to put the items up for auction.
Bans said Memani will not be held accountable for any storage and associated costs payable to the Knysna Sheriff.
Writ
Memani's moveable possessions were attached at his home in Castleton, Piesang Valley Road, Plettenberg Bay, on Thursday 17 July in terms of a writ of execution obtained by Kamkam from the Western Cape High Court.
Bans said Memani is still awaiting an interest repayment on four months' backpay of R389 010,06 he received for the months of May to August 2024, relating to the judgment that set aside the mutual separation agreement and ordered his reinstatement
