State prosecutor Gerrie Nel said in one of his submissions that it was abundantly clear that the state was not happy with the factual findings by the trial court.
However, he said that in his heads of argument they were cautious about attacking the factual findings by Judge Thokozile Masipa but would deal with errors in law.
Submissions by defence counsel Barry Roux came under close scrutiny by several of the judges.
The National Prosecuting Authority said it had a reasonable prospect of success of a successful appeal.
