Tom Meyer (52) from Rheenedal, who was in police custody for allegedly being in possession of dagga and assault on Moos, died in hospital from injuries sustained during his arrest on February 27.
It appears that the sheer volume of witnesses, approximately 24 (the majority appearing for the state), was partly to blame for the case being remanded to May 10.
According to a local attorney, Magistrate Herman Bühr has a jovial demeanour, and often tries to lighten the traditionally serious atmosphere of the courtroom.
This became evident when state prosecutor, Renette de Waal, drew a picture of the police van depicting smoke bulging from its exhaust, and Bürh said, "From this picture it looks as if the policemen were also smoking on that day", to which laughter rippled throughout the gallery.
The atmosphere among the family and friends of Meyer was very different as they sat waiting to be called as witnesses. They spoke of the seriousness of the crime and that a person had lost his life. "It’s definitely not a laughing matter," said a bystander.
The accused
The three accused looked relaxed during a court recess, laughing and joking with family and friends outside the court.
A photo of Klein appeared in the previous edition of the Knysna-Plett Herald for being chosen as the new chairman of the board of Knysna United Football and Rugby Club. Richard Davies, spokesperson for the club, was asked Klein’s pending trial would have any effect on his position within the club.
"Aschin [Klein] is our new chairman and is fairly key to affecting many of the changes we are putting in place. He is very committed and is putting a lot of effort into the drive to improve rugby in and around Knysna."
He continued, "Naturally there will be some discussion regarding his involvement - and his guilt or innocence - in the case until the matter is concluded, but he is innocent until proven guilty and has our full support."
Davies reiterated that they would continue with Klein in the chair until further notice.
Davies expressed some concern about the possible reaction of some members of the public, saying, "I hope that it doesn't hamper our cause - people can sometimes be very judgemental - and I am prepared to personally meet and discuss the matter with anyone who has any specific concerns."
