KNYSNA NEWS - They say perseverance pays off, and maybe it will be fourth time lucky for former Knysna Taxi Association secretary Mandla Tyolo to finally get the bail he has already tried three times to secure but failed.
Tyololo's trial on the charge of conspiracy to murder Victor Molosi last year was supposed to start on Thursday 4 April but was postponed to 18 April for pretrial proceedings.
In a surprising turn of events, however, Tyololo applied for bail once again in the Knysna Magistrate's Court on Tuesday this week.
His legal council, Ezra Morrison, submitted the new application before magistrate Flippie Hendricks at the Knysna Magistrate's Court – after Hendricks denied bail twice before and the Cape Town High Court dismissed an appeal in December last year.
One of the new facts Morrison introduced in support of her client's latest bail application, was what she referred to as his emotional state due to the trauma of having been incarcerated since August 2018, and that he has seen psychologists to this effect.
State prosecutor MP Heyns insisted that the defence produce evidence in the form of statements from the psychologists before Tyololo's emotional state could be accepted as new facts, and requested a postponement for him to consult with the investigating officer, Detective Barnard Wilson, and with state prosecutor in the bail application Vandana Premchard.
The bail hearing was subsequently postponed to 6 May.
