Update
KNYSNA NEWS - The matter against the three accused men arrested in connection with the murder of Victor Molosi will be heard in the high court on 5 February next year.
The decision by the Directorate of Public Prosecutions (DPP) was read out on record in the Knysna Magistrate's Court on Thursday 13 December when the accused – former Knysna councillor Velile Waxa, municipal official Mawande Makhala and Cape Town resident Vela Patrick Dumile – briefly appeared.
Dumile was in court without any legal representation after attorney Thabo Nogemane indicated during the bail application ruling recently that he had only been on record for purposes of bail.
Magistrate Flippie Hendricks advised Dumile that he is entitled to a legal representative and that should he not be able to afford one, that the state could appoint one for him, to which Dumile replied, “I want to contact my family and appoint my own lawyer.”
He went on to request a transfer to the Caledon Correctional Services in Cape Town because “since the time of my arrest I have not had visitors, I wish to be transferred closer to my family in Cape Town”.
Hendricks then explained to Dumile that he cannot simply be transferred without good cause or reason, and that the accused needs to make an application for such.
Waxa's lawyer Daan Dercksen also had a request, asking that his client who is kept at Uniondale Correctional Services be allowed to stay at the Knysna Correctional Services for a few days while he is in consultation with his lawyers to appeal his removal as Ward 4 councillor.
The court agreed that Waxa could remain at the Knysna facility from the Thursday (13 December) until noon on Tuesday 18 December.
ANC secretary Moyisi Magalela commented after court proceedings: “The ANC in Knysna is pleased that the trial will finally commence so that the family and the community of Knysna can finally have justice for the gruesome and senseless murder of comrade Molosi.”
He congratulated the NPA for being resolute by first denying the accused bail and ready to start with the trial, and added, "We have always reiterated our trust in our justice system."
