PLETTENBERG BAY NEWS FLASH - Casparus Nell, a logger found guilty of culpable homicide after a felled tree fatally wounded a hiker on the Tsitsikamma Trail in April 2006 in what has been described as a "freak accident", has taken his case to the Western Cape High Court.
Nell, now in his early sixties, was sentenced to an effective 18 months correctional services in the Knysna High Court in June 2011, more than five years after the tragic incident that claimed the life of Willeen Taljaard.
In the High Court on May 11, Nell appealed before Judge Andre le Grange and acting Judge Rob Stelzner that his conviction be set aside or, alternatively, that his entire sentence be suspended.
